Regulation defining the acts described in section 17 of the Pharmacy Act which may be performed by classes of persons other than pharmacists

DIVISION I
GENERAL PROVISIONS
1.01. This Regulation is made under subparagraph a of the first paragraph of section 10 of the Pharmacy Act (chapter P-10).

1.02. In this Regulation, the word “pharmacy” means the place where a pharmacist practises his profession in accordance with section 17 of the Pharmacy Act (chapter P-10).

1.03. Nothing in this Regulation shall be interpreted as restricting the privileges granted to an establishment under the second paragraph of section 18 of the Pharmacy Act (chapter P-10).

DIVISION II
DEFINITION OF ACTS
2.01. Every person of full age who is a clerk in a pharmacy may, under the supervision of a pharmacist as provided in section 31 of the Pharmacy Act (chapter P-10):
(a)  sell medications or poisons; and
(b)  make the patient’s record.

2.02. Every person of full age with 5 years of experience as a clerk in a pharmacy may, under the supervision of a pharmacist as provided in section 31 of the Pharmacy Act (chapter P-10):
(a)  sell medications or poisons;
(b)  make the patient’s record; and
(c)  perform the technical tasks related to the preparation of medications by prescription or not.

2.03. For the purposes of sections 2.01 and 2.02, a pharmacist shall not have at the same time more than 4 persons under his control and constant supervision.
