Act respecting the Conseil des universités

1. A body, hereinafter called “the Council”, is established under the name of “Conseil des universités”.

2. The principal function of the Council shall be to advise the Minister of Higher Education and Science regarding the needs of higher education and university research and to make recommendations to him regarding steps to be taken to meet such needs.

3. The Council may, in particular:
(a)  study the needs of higher education, taking into account the cultural, scientific, social and economic needs of Québec, its human and material resources and student enrolment;
(b)  suggest short- and long-term goals to be pursued to ensure the development of higher education, and revise such goals periodically;
(c)  advise the Minister of Higher Education and Science regarding the development of universitarian institutions and the creation of new establishments of higher education;
(d)  suggest to the Minister of Higher Education and Science the norms which may be adopted as regards standardization of the accounting methods of establishments of higher education;
(e)  study the annual operating and investment budgets of establishments of higher education;
(f)  recommend the amount and apportionment of annual appropriations to be made available for subsidies to establishments of higher education;
(g)  recommend appropriate steps to ensure co-ordination and collaboration between establishments of higher education and between higher education and other levels of education;
(h)  maintain close ties with bodies responsible for research and make recommendations to the Minister of Higher Education and Science respecting the development of university research;
(i)  collaborate in the preparation of laws and regulations respecting higher education and university research.
The Council may also, with the authorization of the Minister of Higher Education and Science, cause to be carried out studies and research deemed useful or necessary for the pursuit of its objects.

4. The Minister of Higher Education and Science shall submit for the opinion of the Council:
(a)  any program which he intends to implement for the development of higher education and university research at each important phase of its elaboration;
(b)  the annual operating and investment budgets of establishments of higher education;
(c)  the apportionment among establishments of higher education of the total amount of the annual appropriations made available for higher education and university research;
(d)  the steps which he intends to take to ensure co-ordination between establishments of higher education;
(e)  rules respecting the standardization of the accounting methods of establishments of higher education.

5. The Council shall consist of the following members, appointed by the Government upon the recommendation of the Minister of Higher Education and Science:
(a)  the president;
(b)  nine persons from the university milieu, appointed after consultation with the authorities, faculty and students of the universities;
(c)  four persons appointed after consultation with the most representative associations in the business and labour fields;
(d)  the president of the Commission de la recherche universitaire;
(e)  two officers of the Government.

6. The president of the Conseil des universités shall be appointed for five years. He shall devote his time exclusively to the work and duties of his office.
His salary shall be fixed by the Government.

7. The members of the Conseil des universités contemplated in paragraphs b and c of section 5 shall be appointed for four years. Their term of office shall not be renewed consecutively more than once.
As regards the first appointments, however, the first thirteen of such members shall be appointed, four for two years, four for three years and five for four years.
At the end of their term, the members of the Council shall remain in office until they are reappointed or replaced.
The president of the Commission de la recherche universitaire shall continue to be a member of the Council as long as he is in office.

8. In the case of the members contemplated in paragraphs b and c of section 5, any vacancy shall be filled by following the method prescribed for the appointment of the member to be replaced, but only for the unexpired portion of such member’s term of office.
Such a vacancy shall result from death, resignation, absence from a number of meetings to be determined by by-law of the Council and, in the case of persons appointed under sub-paragraph b of section 5, when they cease to form part of the university milieu within the meaning of the by-laws of the Council.

8.1. If the president is unable to act, he may be replaced by a person appointed by the Government to perform the duties of the president for as long as he is unable to act. The Government shall fix the remuneration, social benefits and other conditions of employment of the person appointed.

9. No member of the National Assembly may become or remain a member of the Conseil des universités.
The members of the Conseil des universités shall be domiciled in Québec.

10. The members of the Conseil des universités other than the president shall be indemnified for their expenses in attending meetings and shall receive an attendance allowance fixed by the Government.

11. The secretary of the Council shall be appointed, on the recommendation of the Council, by the Government which shall fix his salary; he shall not be dismissed except in accordance with section 33 of the Public Service Act (chapter F-3.1.1). Any other functionary or employee of the Council shall be appointed and remunerated in accordance with the said Public Service Act.

12. The Council shall meet at least six times each year.

13. An advisory body to the Council is established under the name of “Commission de la recherche universitaire”. The members of such Commission shall be appointed by the Government upon the recommendation of the Council.
The function of the Commission shall be to advise the Council on any matter relating to university research in Québec.

14. The president of the Commission shall be appointed for three years by the Government, after consultation with the Council.
The Council may fix the number of other members of the Commission which shall not exceed eight, their term of office and the procedure to be followed for their replacement.
The Council, with the authorization of the Minister of Higher Education and Science, may establish committees, including technical advisory committees and special committees, and determine the composition of such committees and the term of office of their members.

15. The members of the Commission de la recherche universitaire shall receive no salary as such; they may be indemnified for their expenses in attending meetings and receive an attendance allowance fixed by the Government.

16. The Council, by by-law, may determine any matter requisite for its internal management.

17. The Council, not later than 30 June in each year, shall make to the Minister of Higher Education and Science a report of its activities for its preceding fiscal year; such report shall also contain all information which the Minister may prescribe.
Such report shall be laid before the National Assembly if it is in session, or, if it is not, within thirty days of the opening of the next session.

18. The Minister of Higher Education and Science shall have charge of the carrying out of this Act.

REPEAL SCHEDULE

In accordance with section 17 of the Act respecting the consolidation of the statutes (chapter R-3), chapter 64 of the statutes of 1968, in force on 31 December 1977, is repealed, except sections 18 and 20, effective from the coming into force of chapter C-58 of the Revised Statutes.
