Regulation respecting the issuance and renewal of permits for institutions
Act respecting health services and social services for Cree Native persons
(chapter S-5, s. 173).
DIVISION I
GENERAL
1. Application for the issue or renewal of a permit to operate an institution shall be made to the Minister of Health and Social Services by filling the form prescribed in Schedule I.
Application for the issue of a permit must be accompanied by a statement of the objects pursued and of the means to attain them. In the case of a legal person, a resolution of the board of directors authorizing the application must be attached to the form and, in the case of a partnership or a person operating an enterprise under a name which does not include the person’s surname and given name, a certified copy of the declaration required under the Act respecting the legal publicity of enterprises (chapter P-44.1) dated less than a month before the date of the application must also be attached.

2. Application for renewal of a permit must be submitted at least 6 months before the date of its expiry.

3. Any applicant for the issue or renewal of a permit must:
(1)  be a Canadian citizen or a permanent resident within the meaning of the Immigration and Refugee Protection Act (S.C. 2001, c. 27);
(2)  be domiciled in Québec;
(3)  be solvent;
(4)  not have received a sentence under the Criminal Code (R.S.C. 1985, c. 46) which has not been satisfied;
(5)  forward to the Minister any information he may require.

4. Application for a first operating permit for a private institution not covered by sections 176 and 177 of the Act respecting health services and social services for Cree Native persons (chapter S-5) must be accompanied by budget estimates for the first 2 years of operation.

5. A legal person may not apply for the issue or renewal of a permit if any of its members is:
(1)  a person whose sentence under the Criminal Code (R.S.C. 1985, c. 46) has not been satisfied;
(2)  a person who, during the preceding 3 years, has been the subject of disciplinary measures under section 170 of the Act or of a fine under sections 179 and 180 of the Act.

6. The permit holder must post his permit in the institution.
He must also notify the Minister of any change of address.
