Regulation respecting roadside advertising
Roadside Advertising Act
(chapter P-44, s. 22).
The fees prescribed in the Regulation have been indexed as of 1 January 2024 pursuant to the notice published in Part 1 (French) of the Gazette officielle du Québec of 30 December 2023, page 898. (s. 2)
DIVISION 1
PERMITS
1. In order to obtain a permit referred to in section 7 of the Roadside Advertising Act (chapter P-44), an applicant shall complete Part 1 of the permit application form in Schedule 1 or, in the case of a separate permit prescribed in the last paragraph of section 7, Part 1 of the form in Schedule 2. He shall forward his application to the Minister of Transport with the annual fees exigible and the following documents:
(1)  the plan of the advertising sign prepared by an architect or engineer, where the advertising sign is placed 60 m or more from a highway, rest area or lookout;
(2)  in the case of a legal person, a copy of its constituting act and a copy of the resolution authorizing the application for a permit;
(3)  where applicable, a copy of the municipal certificate authorizing the erection of the advertising sign;
(4)  where applicable, a copy of the decision of the Commission de protection du territoire agricole authorizing the erection of the advertising sign.

2. The fees exigible for obtaining and renewing a permit shall be:
(1)  $63.25 for a permit issued for a period of 1 year;
(2)  $128 for a permit issued for a period of 3 years;
(3)  $193 for a permit issued for a period of 5 years.
The fees shall be paid to the Minister of Transport by means of a postal money order or a cheque made out to the Minister of Finance.

3. Sections 1 and 2 apply to an application for renewal of a permit.

4. The identification plate issued with the permit shall be in accordance with Schedule 3.

DIVISION 2
CONSTRUCTION, ERECTION AND MAINTENANCE
5. An advertising sign that is placed at 60 m or more from a highway, rest area or lookout, shall be constructed in accordance with a plan that has been prepared by an architect or engineer.

6. The guy cables of an advertising sign shall be covered by yellow sheathing for a length of at least 3 m from the ground.

7. The display panel of an advertising sign shall be painted or stained.

8. The dimensions of a commercial advertising sign or a non-commercial advertising sign referred to in subparagraph 1, 3, 4 or 5 of section 16 of the Act may not exceed:
(1)  1.20 m by 1.20 m where it is placed less than 30 m from a highway, rest area or lookout;
(2)  2.5 m by 3.65 m where it is placed 30 m or more but less than 60 m from a highway, rest area or lookout;
(3)  4 m by 7.60 m where it is placed 60 m or more but less than 90 m from a highway, rest area or lookout;
(4)  5 m by 15 m where it is placed 90 m or more but less than 300 m from a highway, rest area or lookout.

9. A contravention of any of sections 5 to 8 is punishable under paragraph 4 of section 24 of the Act.
